1. About COLD MAY

  • The company is based in Falköping, Högfalevägen 1 A, 521 34 Falköping.

2. Ordering

  • Once you have completed your order, an order confirmation will be sent to your email address. The confirmation will contain all the details regarding the products, prices, billing, and delivery address.
  • If there is any error in the order confirmation, please contact us immediately via email at info@coldmay.se

3. Delivery

  • Our normal delivery times are 2-5 days in Sweden and 2-6 days within the EU. Please note that orders placed on weekends will be shipped at the earliest on the following Monday.

4. Prices

  • All prices in the store are stated in SEK and all prices include 25% VAT.
  • We reserve the right to make price changes due to supplier price changes, misprints in the price list, and errors in prices due to incorrect information, and we reserve the right to adjust the price.

5. Right of Return

  • When purchasing goods on the website, you, as a customer, have a statutory 14-day right of withdrawal, which applies from the moment you receive an ordered item.

5.1 When exercising your right of return:

  • You must notify us that you wish to withdraw. The notification should be sent to us at info@ COLD MAY.se. In your message, clearly state your name, address, email address, order number, and the specific items for which you are requesting a return.
  • You should return the products to us immediately and no later than within the statutory 14-day period after the withdrawal notification.
  • If the return is made within 14 days and under the condition that the product is in unchanged condition, COLD MAY will cover the return shipping, delivery, and condition of the products upon return. Therefore, the products should be well-packaged and in their original packaging.
  • Products that are sealed for health and hygiene reasons, such as underwear, cannot be returned if the seal has been broken by the consumer.
  • Regarding the refund amount, we reserve the right to deduct an amount equivalent to the depreciation compared to the original value of the product if it has been used or damaged.

5.2 The right of withdrawal does not apply to:

  • Products that have been sealed (plombed) for health or hygiene reasons and where the seal (plomb) has been broken by you.
  • Products that are of a sealed audio or video recording nature and where the seal has been broken by you.
  • Custom-made products that have been tailored specifically to your preferences or have a clear personal characteristic.
  • Services that have been fully performed and where you have expressly consented to the service commencing without the right of withdrawal.
  • Perishable goods, such as food.
  • Single issues of newspapers or magazines.

6. Complaints and Claims

  • We inspect all products before they are sent to you. If the product is still damaged or wrongly dispatched upon arrival, we commit, in accordance with applicable consumer protection laws, to rectify the error free of charge.
  • You must always contact us for approval before returning a defective item.
  • The complaint should be sent immediately after the defect has been discovered.

6.1 How do you proceed with a complaint?

  • Any faults or defects should always be reported to info@ COLD MAY.se, where you provide your name, address, email address, order number, and a description of the issue.
  • If we are unable to rectify the problem or provide a similar product, we will refund you for the defective product in accordance with applicable consumer protection laws. We cover the return shipping costs for approved complaints.
  • We reserve the right to reject a complaint if it is found that the item is not defective according to applicable consumer protection laws. In cases of complaints, we follow the guidelines of the Swedish National Board for Consumer Disputes (Allmänna Reklamationsnämnden), see arn.se.

7. Limitation of Liability

  • We do not assume any responsibility for indirect damages that may arise as a result of the product.
  • We do not accept any liability for delays/errors caused by circumstances beyond the company’s control (Force Majeure). These circumstances may include labor disputes, fire, war, government decisions, reduced or non-delivery from suppliers.
  • Furthermore, no responsibility is taken for any changes to products/product characteristics made by respective suppliers and other factors beyond our control.

8. Product Information

  • We reserve the right for any printing errors on this website as well as product sell-outs. We do not guarantee that the images accurately represent the appearance of the products, as slight color variations may occur due to differences in computer screens, photo quality, and resolution. We always strive to display the products as accurately as possible.

9. Information about Cookies

  • In accordance with the law on electronic communication, visitors to a website must be provided with information regarding the use of cookies for privacy purposes. The information in the cookie can be used to track a user’s browsing activities. A cookie is a small text file that the website you visit requests to store on your computer in order to provide access to various features. COLD MAY is responsible for the processing of personal data provided by you as a customer. Your personal data is processed by us to manage your order and, in cases where you have subscribed to newsletters or promotional offers, to customize marketing according to your individual needs.

10.4.1 Payment provider

During the payment process, information is shared with our payment provider. The stored information includes first name, last name, address, email address, and phone number. If you choose to pay by invoice, your social security number will also be stored by the payment provider. This information is stored to process the payment and protect the parties against fraud.

The payment providers we use are: Klarna.

10.4.2 Shipping carrier

To deliver your orders and fulfill our agreement, we must share specific information with the shipping carrier. The information shared includes first name, last name, and delivery address. Email address and/or mobile number may also be shared with the shipping carrier for notification purposes.

The shipping carriers we cooperate with are: PostNord and DHL Express.

10.4.3 Newsletter

If you have chosen to subscribe to our newsletter, your first name, last name, and email address will be shared with our newsletter service provider. This is done to keep you updated with information and offers for marketing purposes.

10.5 Right of access

You have the right to request an extract of all information we hold about you. The extract will be delivered electronically in a readable format.

10.6 Right to rectification

You have the right to request the correction of inaccurate information or the completion of incomplete information.

We use industry-standard SSL/TLS and one-way hash algorithms to store, process, and communicate sensitive information such as personal data and passwords securely.

We use a Swedish platform, Quickbutik, operated by Quickbutik AB based in Helsingborg.

11. Changes to the Terms and Conditions

We reserve the right to make changes to the terms and conditions at any time. Changes to the terms and conditions will be published online on the website. The amended terms and conditions will be deemed accepted in connection with orders or visits to the website.

12. Disputes and Choice of Law
